Brexit driving rise in custody battles, lawyers claim
An increase in parents bringing legal action over access to their children is linked to a rush of EU citizens leaving Britain before Brexit, lawyers claim.
In the two years after the referendum in June 2016, the number of child arrangement orders increased by nearly 20 per cent, figures from the family courts show. There were more than 66,000 orders made last year.
Recovery orders made by the courts in relation to abducted children also increased by 25 per cent to 640 over the period.
“A key factor in the steady rise of child custody disputes over the past decade is the growing proportion of the population born outside the UK, or with links to foreign countries,” Barbara Bitis, a solicitor at the firm Nockolds, said.
Brexit “has prompted a wave of EU nationals to leave the UK” and that many of them have children in Britian, she added.
